Abstract

This article analyses the relationship between international commercial arbitration and European Union law, with particular focus on the limits of the application of Article 267 of the Treaty on the Functioning of the European Union (TFEU) to arbitral tribunals. It examines the case law of the Court of Justice of the European Union, in which arbitral tribunals are (or are not) recognized as “courts or tribunals of a Member State” within the meaning of Article 267 TFEU. The article also discusses the future prospects of international commercial arbitration in the context of European Union law.
