Šiame straipsnyje tiriamas imperatyvių normų poveikis valstybės imunitetui taikyti ir analizuojama, ar jus cogens normų pažeidimas reiškia valstybės atsisakymą remtis valstybės imuniteto doktrina. Taip pat šiame straipsnyje keliamas klausimas, ar valstybė suverenias galias (acta iure imperii) gali išreikšti veiksmais, pažeidžiančiais jus cogens normas, ir taip pasinaudoti valstybės imuniteto teise.
This article investigates the impact of peremptory norms on State immunity assertions and analyses whether the breach of a jus cogens norm result the loss of immunity of the state or its representative alleged to have violated this norm. Also in this article is raised the question whether State acts that violate jus cogens norms can be regarded as acta iure imperii and granted immunity.
