Abstract

This article aims to examine the potential impact of hybrid warfare on civil legal relations. Four relevant groups of hybrid warfare measures are distinguished: disinformation campaigns, cyberattacks, diversionary attacks, and other measures. In analyzing the impact of disinformation campaigns, it was observed that such campaigns may create preconditions for violations of individuals’ honor and dignity, which would lead to increased application of the remedies provided for in Article 2.24 of the Civil Code, and may also harm the reputation of commercial entities. With regard to cyberattacks, it was noted that they complicate the identification of the person who caused the damage. The analysis of diversionary attacks showed that sabotage leads to stricter state regulation and increases the obligation of private entities to more actively ensure the security of their infrastructure. Other hybrid warfare measures, although difficult to define systematically, manifest most clearly in the transport sector and raise different issues of state liability and risk allocation.
