This article, based on the Constitution of the Republic of Lithuania, the Code of Criminal Procedure of the Republic of Lithuania, the jurisprudence of the Supreme Court of Lithuania and the European Court of Human Rights, as well as other relevant sources, analyses judicial impartiality in criminal proceedings. To achieve this aim, it examines the origins, concept, content of this principle of criminal procedure, and relevant case law. In the practice of the Supreme Court of Lithuania, it is established that the principle of judicial impartiality is an integral part of an individual’s constitutional right to a fair trial, and its guarantee in criminal proceedings also implies a fair and just process. A well-founded belief in judicial bias triggers the mechanism of recusal or disqualification, which is essential for ensuring the proper implementation of individual rights.
